PERSONAL TRAINING TERMS & CONDITIONS

 

Introduction

Your agreement is with your personal trainer (the “Trainer”) who delivers your training.

These Terms and Conditions form part of your agreement with the Trainer. You understand that the Trainer is self employed and you are entering into a contract with them alone.

Your instructions to commence personal training will constitute acceptance of these Terms and Conditions when you will become a client (a “Client” or “you”). You are asked to pay special attention to the provisions related to cancellations. This does not affect your statutory rights.

 

Trainer’s Obligations

The Trainer will use his / her skills and knowledge to design a safe programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history.

The Trainer will provide the coaching, supervision, advice and support that you will need to achieve your goals. Each personal training session will last between 45 and 60 minutes (a “Session”).

You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the sessions. In particular you acknowledge that individual results may vary and no particular result is guaranteed by your Trainer.

All Client information will be kept strictly private and confidential.

 

Your Obligations

It is understood between you and your Trainer that both must commit to your training programme 100% in order for you to achieve results.

You are required to wear appropriate clothing and footwear.

You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) before undertaking your first personal training session.

Your Trainer may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.

You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.

If your Trainer requires further medical information from a practitioner, you must provide such details.

You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by his/her gross negligence or intentional act.

Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

 

Cancellation and Refunds

24 hours notice of cancellation or postponement is required for all appointments.

Once purchased, your Sessions are non-refundable.

 

Lateness Policy

If the Trainer is late additional time will be added to the Session or to subsequent Sessions.

 

Health and Safety

Your Trainer has £10 million public liability insurance cover.

The Sessions will be on your premises, you are therefore responsible for providing a safe exercise environment.

 

General

You understand that in the unlikely event of your Trainer being unable to continue your training, for any reason, you can request a full refund from your Trainer for any unfulfilled Sessions.

The Trainer has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. The Trainer will notify you of any change. When such a change is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.

You are responsible for keeping all your contact information and marketing preferences up to date with the Trainer. In order to comply with the Data Protection Act 1998 and from 25th May 2018, the General Data Protection Regulation (GDPR), the Trainer will only do what you ask him / her to do, or what you have given him / her permission to do with any personal or sensitive information held about you.

Your training may be filmed or pictures taken for marketing purposes. Your participation in a Session means you consent to photography, filming and sound recording which may include you as a Client and its use in commercial distribution without payment or copyright.

This agreement is governed by the laws of England and Wales and is subject to the jurisdiction of the English courts.

FITNESS CLASSES - terms and conditions

MOVE WITH MUMMA / MANDA CROFTS FITNESS TERMS AND CONDITIONS

 

All products and services of 'Manda Crofts Fitness' and 'Move with Mumma' and its subsidiaries and affiliates are subject to the terms and conditions of the applicable agreements governing their use. The Terms are to be read by you together with any terms, conditions or disclaimers provided in the pages of the Site. In the event of any conflict, the terms provided in the pages of the Site will govern. The information, material and content provided in the pages of the Site (the “Information”) may be changed at any time without notice. Changes may be made to the Terms at any time without notice by updating this posting. You agree to review the Terms regularly and your continued access or use of the Site will mean that you agree to any changes.

Your class instructor will use her skills and knowledge to design a safe programme of exercise that will take into account your fitness levels and medical history.

All Client information will be kept strictly private and confidential.

 

CLASS / SESSION BOOKINGS (Booked Single Sessions / Pre-paid Classes)

You have a right to cancel any class that you have booked and paid for and can do so up to 2 hours before the class start time as we understand that sometimes due to unforeseen circumstances you are unable to attend. We will endeavor to re-book you onto the next available class.

However, if you do not cancel, do not make contact with us prior to the class start time to let us know that you are unable to attend and do not show up, you will automatically lose this booking payment as there are others who may miss out on a place if the class is showing full.

We would really appreciate it if you could let us know if you have any problems attending any of our sessions prior to the start time.

 

BLOCK BOOKINGS / MEMBERSHIP PACKAGES

Blocks of 12 Sessions must be used within 4 months from date of purchase. Any unused sessions will be lost and cannot be transferred past the 4 months period or to another member.

 

If you are unable to use your booked sessions due to a medical condition affecting you or your baby, please do let us know and we can look at extending your sessions for you. In circumstances of long term illness or injury, we are able to offer a full refund, this requires a doctor’s note or healthcare professional equivalent and is at the discretion of Move with Mumma / Manda Crofts Fitness.

 

For Move with Mumma Membership Packages, if you are returning to work early, you are able to free transfer your sessions to a friend who is already a Move with Mumma member. Any sessions transferred will also be subject to the remaining time frame of the sessions when transferred over. Sessions cannot be transferred for cash or refunded.

SAFETY

Safety is a top priority for both Mums and Babies in our Move with Mumma sessions. Therefore, if your little one is mobile and your sessions instructor has any concerns about their safety and the safety of other babies, they reserve the right to request that you secure your little one in their pushchair for the remainder of the session.

We will do our upmost to look after your little ones to make sure that you get the most out of your session. However, your child is your full responsibility throughout the duration of every session.

In our Move with Mumma sessions Mums may exercise together with their babies, we ask that Mum remains with their baby at all times throughout the class and that Mum is responsible for her own baby throughout the entire class.

Your Trainer has £10 million Public Liability Insurance cover, including additional cover for Mother & Baby Classes and Holistic Insurance cover.

You can book online here. You can book a single session or a block booking of 10 sessions at a reduced rate. 

 

What's included in the session?

The 90 minute sessions includes:

45 minutes Fitness for Mum

30 minutes Baby Massage & Bonding (Free bottle of baby massage oil at your first session)

15 minutes Social Time

 

What shall I wear? 

Please wear proper trainers and layers of exercise gear. A good, supportive sports bra.

 

What if my baby cries?

All babies cry and we don't mind, we want you to feel comfortable in class.

 

How soon after birth can I attend a postnatal fitness class?

You can exercise following your GP check, 6-8 weeks after a natural delivery and 10-12 weeks after a c-section. 10-12 weeks is recommended after a c-section to minimise any potential trauma to your scar and to allow it to heal properly. You shouldn’t be lifting anything heavier than your own baby during this time.

 

It is essential that you have had your postnatal check-up and completed our health form before attending any sessions.

Baby Bonding Time and Baby Massage

 

Nurture Fitness sessions for Mums and Babies (0-6 Months)

Our Nurture Fitness baby bonding time is designed for babies 0-6 months, we will carry out simple baby massage routines to help you connect and communicate with your baby. We will play sensory activities using fun songs and rhymes to help stimulate baby's development and just enjoy spending time with baby with cuddles and connection. Baby massage exercises include movement, stretches and opportunities to relax and focus on the breath.

 

It is advised that babies do not attend any sessions if they are unwell or have a temperature.

 

Baby massage should not be carried out if baby has had a vaccination less than a week before, is suffering an injury, illness or has a swelling or sore of any kind unless medical permission has been given.

 

You are fully responsible for the health of your child and yourself in the sessions and should there be any medical changes you must consult your instructor.

 

Frequently Asked Questions.

What age can baby be massaged from?

A great time to join Nurture Fitness would be around 6-8 weeks after birth once Mum and Baby have both had a postnatal check-up with your medical professional.

 

What if baby cries or moves around during the massage?

No worries at all. Your baby may prefer to change position or enjoy a cuddle instead. Always take the lead from your baby in massage and respond to their needs.

 

What if my baby needs feeding or is sleeping though the class?

Nurture Fitness is a relaxed environment for mum and baby, so if you need to feed then please do and if your baby needs to sleep then allow them to.

 

What should I bring to the class for baby?

A favourite cuddly toy or comforter for your baby. A comfortable mat, towel, cushion or blanket for baby and all the normal things you need for your baby when you go out.

 

Do we use oils during massage?

Yes we do, oil lubricates baby's skin and reduces friction. A free bottle of Baby Massage Oil will be included in your first session. Before trying any baby massage oil, dab a little on baby’s hand to see if it compatible with the skin. If any rash develops, wash off completely and avoid using that oil. If baby has eczema, it's better to use medical emollient cream or ointment.

 

Cherish Fitness sessions for Mums and Babies (6-18 Months)

In the baby bonding section of the Cherish Fitness session (Learn, Stretch & Play) we do not use massage oil as we do a variety of different developmental activities. With older babies and toddlers, massage will have to be very flexible and strokes changed and adapted. This is because it can be difficult to keep little ones still and in one place for a long time. The key is to be relaxed and do whatever your child wants you to do. 

 

The golden rule is: Follow the lead of your child, have fun and be flexible. Even if you only manage to do five minutes massage with your child this will be beneficial. Your child will soon recognise and enjoy the benefits of massage and want to join in

 

There are some occasions where it is not advisable to massage your child. If your child is unwell, has vomiting, fever or diarrhoea, is receiving medical treatment, has been immunised in the last 72 hours or if you have any concerns about your child’s health, then contact your local GP or health visitor before undertaking a massage.

 

It is really important to ask your child if they want a massage before you begin because it gives them the opportunity to consider if they want a massage and it also shows you care about and respect your child’s opinion. You know your child better than anyone and if they do not want a massage then it’s better leave it until another time.

What if my child wants to move around?

We don't mind! You may find that your child wants to move around during the session or not join in with some of the activities. As long as all the children in the class are safe, we understand that older babies and toddlers often need to move. Try to engage your child in the class with lots of eye contact, singing and body contact. Remember you are learning about massage and yoga together. If you have an active child, then keep sessions short. It’s better to do a minute of massage with a happy child rather than keep up with the session if the child doesn't want to join in. There will be plenty of opportunity to practice during another session or at home.

 

You are fully responsible for the health of your child and yourself in the sessions and should there be any medical changes you must consult your instructor.

 

Contraindications to massage include:

Open or weeping wounds

Infected skin irritations

Fractures or other acute injuries

Bleeding

Massage over an unhealed navel

Burns, including sun burn

Undiagnosed lumps

Abdominal massage if the infant has hiccups or has just been fed

Sickness

Diarrhoea

Unusual Rash

Redemption

• Gift Vouchers can be used to purchase any Move with Mumma Fitness Programme or Manda Crofts Fitness class or product.

• They may be used to purchase goods of a higher price than the amount on the voucher, on payment of the difference

• No refund will be given if used to purchase goods of a lower amount.

• They cannot be exchanged for cash or to buy another gift voucher.

• If any item purchased with a gift voucher is subsequently exchanged for an item of a lower price, no refund will be given.

Period of validity

• Gift vouchers are valid for 12 months from the date of issue.

 

Cancellation

• Cannot be returned or refunded, except in accordance with your statutory rights, for example in the event they are not of satisfactory quality.

Competition Details

Registration to enter the competition requires a donation of £2.00 to our chosen charity Baby Lifeline. 100% goes to Baby Lifeline.

 

The competition is for babies ages 0-36 months.

 

Votes will be counted from the Website Vote Counters only.

 

Likes and emotions on Facebook do not count as Votes.

 

The closing date for Entries will be the 15th December 2018.

 

The competition consists of 2 Rounds.

1st Round (05.06.18 - 15.12.18). On 15th December 2018, entries ranked #1-25 with the highest number of votes go to the Final Round and the votes will be zeroized.

Final Round (16.12.18 – 31.12.18). On 31st December 2018, the voting closes. The winner will be the entry with the most votes and the runner up will be the entry with the next highest number of votes.

The winner and the runner up will be announced on our website and social media platforms in the first week of January 2019. The winners will also receive a direct email.

 

Entry Requirements

·         You must upload a photo to the website using the service provided in the 'Enter' form. By uploading a photo you confirm that you have read and agree to our Terms & Conditions and your child's profile will be available to view online and on our social media platforms.

·         All submissions for entries to the Baby of the Year 2018 Promotion must be supported by explicit permission of a parent or guardian over 18 years of age of that child to allow reproduction of the image on the website.

 

·         Entrants must hold all rights for visual content uploaded as image owner (parent/guardian) or by holding written consent provided to you by the owner (e.g.: a professional photographer).

 

·         All entry photo’s must be of a baby between 0-36 months.

 

·         All entrants must be under four years old on the date they are entered.

 

·         Entrants must ensure minors are clothed in any photographs provided.

 

·         No entry may contain defamatory content, including but not limited to, images, words or symbols that are widely viewed as offensive to persons of a certain ethnic, religious, racial, sexual - orientated or socioeconomic group.

Your Entry

Entrants agree that photos entered may appear on the homepage of the Baby of the Year 2018 website, on Baby of the Year 2018's social media platforms and any promotional activity Move with Mumma and Manda Crofts Fitness (the Promoters) carry out.

 

Any material created by or on behalf of the Promoters utilizing your submission material or any part thereof is and shall remain the property of the Promoter but for clarity you retain ownership of your submission material. The Winners & the Prize

The winning prize is a baby photoshoot with Wings Photography, based in Chesterfield, Derbyshire, worth £250.

 

This includes either:

·         a newborn mini photoshoot with 5 digital images

or

·         a baby a studio or location mini portrait session with 5 digital images.

       

If the winner is unable to travel to Chesterfield for the prize photoshoot then an equivalent cash prize of £250 will be awarded.

 

The runner up prize is a £50 Voucher for Babyluv. Babyluv deliver across the UK from their online store or you can visit their store in Chesterfield.

 

The winners may be asked to provide copies of certain documents to prove identity and parental/guardianship of the child that has been entered in the competition. Failure to provide these documents may affect the entrant’s eligibility to claim the prize.

 

A list of the winners will be posted on the website no later than one week after the closing date. No correspondence will be entered into with other entrants. We, the Promoters, reserve the right to disqualify any entry if we have reasonable grounds to believe an entry has breached any of the competition terms.

 

The winner and the runner up will be notified by email in the first week of January 2019. The winners will also be announced on our Website and social media platforms.

 

Relatives of the Baby of the Year competition and its approved and credible partner companies are excluded from entering the competition.

 

Delivery of the prizes will be at a mutually convenient time to be agreed upon between the winners and the prize provider.

 

The winners may be asked to take part in promotional activity or advertising organised by Move with Mumma or its partners. This is optional to the winner and can be agreed to take part if so requested.
